The book is written by Nancy Wheeler, an attorney in private practice who has advised counselors on legal and ethical issues for more than 25 years and who manages the ACA-sponsored Risk Management Service, and Burt Bertram, a counselor, consultant, and counselor educator. The authors provide a broad overview of the law and the potential areas of liability that you may encounter in your day-to-day practice. (2) Purchase and take an online test for 6 continuing education credits. Objectives:

  1. The reader will learn relevant legal concepts to gain an understanding of how law and the counseling/mental health fields intersect; the reader will also be introduced to a decision-making model to help solve real-life legal/ethical dilemmas.
  2. The reader will be exposed to emerging legal/ethical issues pertinent to counseling and mental health practice, such as referral of LGBTQ clients, concerns for counselor educators, expansion of HIPAA privacy through implementation of the HITECH Act and subsequent rules, and the impact of social media, online therapy and other electronic interface with relationships in the counseling arena.
  3. The reader will be introduced to key concerns in documentation, dangerous clients, professional boundaries and practice management concerns.
